Interrogatories to be mynystryd to Iohn Pascall gent' one of the deffend{an}t{es} vppon his aunswere to the Bill bill [sic] of Compl{aint} of the right ho{norable} Edwarde Erle of Oxenforde and Edwarde Atslowe Compl{ainan}t{es}

1 Inprimis whether dyd one Thomas Clarke or any of the servant{es} of the said Edwarde Atslowe fell or cause to be fellyd in the name of the right honorable Edwarde Erle of Oxenford or in the name or to the vse of the said Edwarde Atslow Compl{ainan}t{es} before the tyme of the exhibitinge of the Bill by the Compl{ainan}t{es} against thexaminate and others any wood or trees in or vppon one p{ar}cell of Stocke Com{m}on and now callyd by thexaminate Prestons com{m}on lyeinge and beinge in Southe Hanningfeild in the Countye of Essex.

7 Item whome dyd yow fynde vppon the said p{ar}cell of Com{m}on in questyon the sixt daye of Aprill or the xviijth xixth or xxth day of Aprill last past and what sayed they or any of them to yow or to any of yo{ur} Company

8 Item whether dyd yow fynde ^\\the said vjth day of Aprill// one Richarde Thimblebye gent' s{er}vant to the said Erle and Iohn Clarke Thomas Clarke and dyvers other of the s{er}vant{es} and neighbours of the said Edwarde Atslow beinge in goddes peace and the Quenes ma{ies}t{ies} vppon the said p{ar}cell of Com{m}on and in quiett possessyon of the same to the behalfe of the sayd Edwarde Erle of Oxenforde or of the said & Edwarde Atslowe ye or no And what sayed the said Richarde Thimblebye to yow or any of yo{ur} Company And what sayed yow or any of yo{ur} Company to the said Richarde Thimblebye or to any of his company at that tyme

9 Item whether dyd the said Richarde Thimblebye or any of his Company the said sixt daye of Aprill or after the said sixt daye and before the said eightenth day of Aprill require yow or any of yow that suche tytle as yow or any of yow dyd p{re}tende vnto the said p{ar}cell of Com{m}on might be tryed in peacable mann{er} at and by the ordinary meanes of the Lawes of the Realme ye or no And what aunswere made yow or any of yow thervnto

10 Item whether dyd the said Richarde Thimblebye or some other of his Company the said sixte daye of Aprill beinge in goddes peace and the Quenes ma{ies}t{ies} and in quiett possessyon of the said p{ar}cell of Com{m}on to the vse of the said Earle and the said Edwarde Atslow forbyde yow and every or any of yo{ur} Company to fell the wood tymbre or trees then growinge on the said p{ar}cell of Com{m}on in the name of the said Erle and of the said Edwarde Atslow or bothe or any of them ye or no and what aunswere made yow or any of yow thervnto

11 Item whether dyd yow then and ther the sixt daye of Aprill after yow had fellyd fyve trees ^\\or at any tyme after// p{ro}myse the said Richarde Thimblebye that yow wolde not fell any more trees growinge vppon the sayd ^\\p{ar}cell of Com{m}on// vntyll yow had talkyd w{i}th the said Edwarde Atslow beinge then Resydent at London and whether dyd yow p{ro}myse to com{m} vnto him the said Edwarde Atslowe the sixtenth or eightenth of the sayd monethe of Aprill followinge yee or no

12 Item what nombre of trees or Lodes of wood dyd yow and yo{ur} Complices fell and carrye away or cause to be fellyd or carryed away eyther the said sixt day of Aprill or the sayd xviijth or xixth daye followinge and in what ordre dyd yow carrye awaye the said trees And whether dyd yow barke them before yow dyd carrye them ye or no And to what vse have yow conventyd them or any of them./

13 Item whether dyd one Thomas Clarke com{m} vnto yow the said nyntenth daye of Aprill, and fyndinge yow fellinge and carryeinge awaye the wood tymbre and trees growinge then vppon the said p{ar}cell of Com{m}on forbyd yow againe in quiett and peaceble mann{er} in the name of the said Erle ^\\&// of the said Edwarde Atslow to fell or carrye away the said wood tymbre or trees and what aunswere made yow vnto him at that tyme

14 Item whether dyd the said Thomas Clarke or some other of the s{er}vant{es} of the said Edwarde Atslow ^\\the said xxth day of Aprill// offer to laye hold on yo{ur} Rapior when yow offeryd to drawe the same, wyshinge yow to keape the peace and to trye yow [for yowr] tytle by the Lawe

15 Item whether dyd yow the said Iohn Pascall cast a thrust w{i}th yo{ur} Rapyo{ur} at one Richarde ffreeman And whether dyd the said Richard ffreeman offer any violence to yow before or at or after suche tyme as yow dyd thrust yo{ur} Rapio{ur} at him

16 Item whither did Bennett Strutt the said xxth day of Aprill wishe or aduise yow to send for a Harque^\\bu//she And to Charge it w{i}th hayleshott and so to shote att or amongest the servant{es} and Neighbours or hired Labourers of the said Edward Atteslowe yea or no. And whither was not the said Bennett Strutte at that tyme Constable of South Hanningfeilde yea or no. And what other advice or counsaile did the said Bennett Strutt give vnto yow at that tyme or before when and where Touchinge the resistinge, Beatinge, molestinge, or w{i}thstandinge the servaunt{es} or hired labourers of the said Edward Atteslowe from In or vpon the said p{ar}cell of Comon or from the ffellinge or Carryinge of the said wood, Tymber or Trees w{hi}ch that daye they did intend to ffell and carrye.//

17 Item whither did Thomas Tyrrell ffall before the Logge of purpose yea or no And whither might not the said Thomas Tyrrell haue avoided the daunger of the Logge yea or no: And whither did not the said Thomas Tyrrell wishe that he had byne hurte yea or no:

18 Item whither did not the servaunt{es} or hired labourers of the said Edwarde Atteslowe seke by all meanes to releive the said Thomas Tyrrell lyinge vnder the Logge, and to save and p{re}serve him from hurte or daunger. And what did yow or any of yo{ur} Companye in the meane season and w{hi}ch of yow did indevo{ur} yo{ur} selues to helpe the said Thomas Tyrrell And whither was the said Thomas Tyrrell hurte at that tyme yea or no:/

19 Item whither did any of the Servaunt{es} or hired Labourers of the said Edward Atteslowe Crye at that tyme kyll the villayne, kyll the villayne, and w{hi}ch of them did so crye or saye. And whither did not Anthony Isgore at that instant indevour him self to staye yo{ur} Rapier. And what saide he vnto yow or the said Thomas Tyrrell And what weapon had the said Anthony Isgore in his hand. And whither did he strike or offer to strike yow or any of yo{ur} Companye att that tyme yea or no:/
