Oxford vs. Richard Payne, John Lennard, Edward Barthdell, Anthonye Barthdell, et al. (1587)

Interrogatories to be mynistred to Richard Payne Esquyre Edward Barthelett gent' & Anthonye Barthlett gent' & ether of them on the behalf of the Righte Honno{u}rable Edward de Veer Earle of Oxenford./.

1 Imprimis whether was there not a sute longe dependinge betwene one Rob{er}te Herrys gent' & Anne his wief or one of them & youe the saide Richard Payne in the highe Courte of Chauncerye for and concerninge the same lease of the saide Manno{u}r of Alvethley menc{i}oned in the Bill of the Compl{ainant} nowe in question betwene the saide Compl{ainant} & the saide Richard Payne And whether did not the same Rob{er}te Herys deryve downe his Title in the same sute vnto him amongest other thinges by vertue of Thoutlawerye p{ro}nounced againste the saide Iohn Ellyott vppon the saide writt of Exigent nowe in question./ And whether were youe not then a dealer & well acquaynted w{i}the the same sute in the behalfe of the saide Richard Payne And whether did the same Richard Payne or any other of his Counsell at anye tyme duringe that sute goe about to impeche or avoide the Title of the saide Rob{er}te Herys and Anne or either of them in & to the same Lease by reason that the same outlawerye was not iustlye and duelye p{ro}nounced againste the saide Iohn Ellyott / And what was the reason whie the saide Richard Payne did not soe doe yf the outlawrye againste the saide Iohn Ellyott vpon the saide writt of Exigent were not then duelye p{ro}nownced againste the saide Iohn Ellyott /

2 Item what is the reason or what did move yowe more nowe att or againste the tyme of the Triall in the King{es} Benche to loke & examyne the validitie of the same Owtlawrye and in what sorte & manenr the iudgment was p{ro}nownced vpon the saide writt of Exigent againste the saide Iohn Ellyott then it did duringe all the same tyme the sute was soe longe dependinge betwene the saide Rob{er}te Herrys & yowe the saide Richard Payne in the Chauncerye.

3 Item howe longe is it sythens yowe did laste see the same writt of Exigent nowe in queston and at what tyme dyd yowe firste see it & in what place & in whose Custodye was it then and vpon what occasion did yowe se it And whether did yowe or anye other to yo{ur} knowledge will or comaund anye other bodye then yo{ur} self to goe and see it and at what tyme was it, and by whose Counsell or p{er}swasion was the same; & in what sorte was the same writt of Exigent when yowe did firste see it; and whether was it in suche sorte when yowe did laste see the same, as it was at yo{ur} firste sighte therof / And whether did not yowe or some other to yo{ur} knowledge the verye nighte or in the afternone nexte before the cause was to be harde in the King{es} Benche will that the same writt of Exigent sholde be looked into to see if that the last Countye wherin the iudgment of Owtlawrye was pronownced againste the saide Iohn Ellyott were not held w{i}thin lesse then one Monethe nexte after the Countye nexte precedent And whoe was the p{ar}tye that gave that advyce: and whoe was sentt to make that searche, and att what tyme was he sent, and what answere did he bring back and what was the cause that shoulde at that tyme rather move yowe or he that gave that advice then before to make anye suche spedye searche for the same ### And whether did not yowe or some other to yo{ur} knowledge whoe gave that advice afterward{es} saie that even as it was thowghte soe it fell out, or word{es} to that effecte /

4 Item whether doe yowe not knowe that the same writt of Exigent nowe in question was caried eyther solelye alone or in a Bundell amongest others eyther the same morninge in the w{hi}che the saide Tryall was to be had in the King{es} Benche or at some other tyme before that daye to S{er}geaunt{es} Inne in Chauncerye Lane and to the Inner Temple or eyther of them or to som{m}e other place in or nere about London and there shewed to some suche as the saide Ricard Payne or some other for hym did direct & appointe And to whome was the same soe caried or shewed, & by whose direction or appoyntment and by whom was the same soe caried or shewed And at what tyme and at whose request.
